By accessing or using Conspicuous ("the Service"), operated by Workhorse Collective, LLC ("we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

Conspicuous Consumption is a social media management and content curation platform that allows you to:

• Connect your Bluesky account
• View and curate content from multiple social media platforms
• Publish posts and replies to connected networks when you choose
• Read linked articles and save media to your library
• Discover and follow content from various sources

3. User Accounts

To use certain features of the Service, you must:

• Create an account by signing in with Bluesky
• Provide accurate, current, and complete information
• Maintain and update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Post, transmit, or share content that is harmful, abusive, harassing, or defamatory
• Impersonate any person or entity or falsely state your affiliation
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Violate any third-party rights, including intellectual property rights
• Post spam, unsolicited commercial messages, or malicious content

The Service includes AI-powered features for content analysis, enhancement, and recommendations. You acknowledge that:

• AI-generated suggestions are provided "as-is" and may not always be accurate
• You are responsible for reviewing and approving any AI-generated content before posting
• We are not liable for any consequences resulting from the use of AI-generated content
• AI features may be modified, updated, or discontinued at any time

We strive to provide reliable service but do not guarantee that the Service will be available at all times. The Service may be unavailable due to:

• Force majeure events

9. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by disconnecting your accounts in Settings or by contacting us at legal@wrkhrs.co. Upon termination, your right to use the Service will immediately cease.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CONSPICUOUS CONSUMPTION, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

You agree to defend, indemnify, and hold harmless Conspicuous Consumption and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you post or share through the Service

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the District of Columbia and the applicable laws of the United States, without regard to conflict-of-laws rules. The state and federal courts located in the District of Columbia will have exclusive jurisdiction over disputes relating to these Terms.
